Two directors at the Korle Bu Teaching Hospital have sued the hospital’s Chief Executive Officer (CEO), Board Chairman and the entire board at the High Court over moves to remove them from their positions.
The two, Bright Kwame Korkoryie, Director of Finance and Dr. Nuru-Deen Mohammed, Director of Administration, have said the processes to remove them are unlawful.
[contextly_sidebar id=”SNu6dUa2kgWbXhPLnJVljGr5EkpSZB1Q”]They want the court to declare the appointment process to engage new directors while they are at post as unfair and unreasonable.
According to the two, they were duly appointed to their respective positions, insisting they have not indulged in any unlawful act to warrant their removal from office.
According to them, in October 2018, they noticed their positions had been advertised as vacant.
In the lawsuit, which has been sighted by Citi News, they maintain that the “conduct of advertising the plaintiff’s positions as vacant using the said appointment process to engage new directors while plaintiffs are still at post as directors is unfair, unreasonable, arbitrary, capricious, biased, prejudiced and without due process contrary to Articles 23 and 296 of the 1992 constitution of Ghana.”
They said although they had complained, the board refused to follow due process “despite repeated calls or demands on them to act fairly and reasonably.”
They also argued that the Board Chairman of the hospital, Dr. Bernard Okoe Boye, has been exceeding his mandate in the matter.
They want an order of injunction restraining the defendants from “further engaging in any act or process of interviewing candidates for the position of directors of Finance and Administration respectively, per the advertisement of the vacant role of directors of the Hospital until the final determination of this case.”
They also want the court to support their claim that “the conduct of the defendants is calculated at removing plaintiffs from office contrary to Article 191 of the 1992 constitution of the Republic.”
In addition, Bright Kwame Korkoryie wants to be restored as a signatory to the hospital’s account per the Ministry of Health’s manual.
The Korle Bu Teaching Hospital has in recent years been faced with several agitations within its leadership structure, which in some cases had led to CEOs being dismissed.
