Name institutions frustrating you – MP to Martin Amidu

The Member of Parliament for Sekondi, Andrew Mercer, wants the Special Prosecutor, Martin Amidu, to name the institutions he claims are impeding his work.

Mr. Amidu had complained about heads of public institutions frustrating his work in an article he released recently.

On The Big Issue, Mr. Mercer said it “is important that he is clear on the type of people who are impeding his work.”

“For me it was unfortunate he didn’t zone on which kinds of heads of institutions. He should have hit the nail right on the head,” he added.

The MP also reminded that the bulk of public sector rot is actually not committed by politicians.

“If you look at the Auditor General’s report, it will tell you where our focus should be in the fight against corruption. Are the people manning these institutions the same people preventing him [Special Prosecutor] from accessing information?”

What Amidu said

In his complaints, Mr. Amidu said he may be compelled to sue the state to release some documents to aid in investigations.

“The Office of the Special Prosecutor Act empowers the Office to enforce the production of information and documents in the Courts against any public institution that fails or refuses to honour the lawful request of the Office. This Office can also go to the High Court to compel heads of institutions to obey the laws that support the fight against corruption. The consequence will be that in accordance with the civil procedure rules this Office will have to sue the Attorney General as the representative of the State.”

As an example, he said there have also been cases where some heads of institutions interfere with his work by deliberately running concurrent investigations “for the sole purpose of aborting investigations into corruption and corruption-related offences.”
