Chief Justice petitioned to recuse Justice Dotse from election-related cases

The Chief Justice has been petitioned to recuse a Supreme Court judge, Jones Dotse, from any election-related case.

The petition was made by the Alliance for Social Equity And Public Accountability.

It is arguing that rumours of Justice Dotse being nominated as the Speaker of the next Parliament compromises him.

“Considering the fact that the learned Judge seems to be a nominee of the ruling party, we believe that puts the Judge in a prejudicial position incapable of making an independent determination of any election-related proceedings,” it noted in its petition.

The alliance believes “this is enough to prejudice him and as such, calls for his recall from all election-related cases.”

This petition comes as the National Democratic Congress (NDC) flagbearer, John Mahama, has filed a petition challenging the results of the Presidential election.

Mr. Mahama asked the Supreme Court to compel the Electoral Commission to conduct a second election with just him and the incumbent, Nana Akufo-Addo as candidates.

He also wants an order of injunction restraining President Akufo-Addo from holding himself out as President-elect.

The alliance says its petition must be heeded before “empanelling judges to sit on any election-related case so as to protect the image, integrity and independence of the Judiciary especially in adjudicating the pending election petition brought before it by the NDC.”

Justice Dotse was one of the nine judges who sat on the 2012 election petition case in which Nana Akufo-Addo unsuccefully challenged then-President John Mahama’s election victory.
