Kwaku Ansa-Asare, the former Director of the Ghana School of Law, has questioned the ability of Attorney General Godfred Dame to clear his name in relation to a tape recording between him and the third accused in the ambulance case.
During cross-examination, Richard Jakpa, the third accused in the ambulance case, revealed that the Attorney General had been calling him at odd hours to implicate the Minority Leader, Dr. Cassiel Ato Forson.
Dr. Ato Forson, a former Deputy Finance Minister and current Minority Leader, is facing trial for his alleged role in the procurement of faulty ambulances for Ghana. The case has sparked public debate, with some calling for the Attorney General’s resignation.
In an interview with Umaru Sanda Amadu on Face to Face on Citi TV, the former Director of the Ghana School of Law expressed that the Attorney General has behaved improperly, making it challenging for him to vindicate himself.
“I don’t think he can come out, simply because he has misconducted himself. I tried to explain in another interview with a different audience that in the first place, the process that they embarked upon, is unknown to our jurisprudence. It’s not part of our judicial process.
“There’s an accused person who claims that he could be in a position to make repatriation provided the offence of causing financial loss to the state will be dropped, in return for compensation, he will be ready to return or refund the money. Now, under our system, there’s nothing like plea bargaining.
“But there’s what we call plea upon arrangement. In Ghana, if you are tried, everything must take place in the courtroom, before the trial judge.”
He criticised the AG for acting as the counsel for the third accused.
“He was the Attorney General and not counsel for the accused person. This suggestion that the accused person didn’t have counsel is neither here nor there. It’s not the constitutional responsibility of the Attorney General to convert himself into the accused person’s counsel. That is not what the constitution says.”
He added that the meeting at the residence of the Supreme Court judge “makes it worse.”
