ADS Media Agency, an information technology service provider, has sued the nation’s broadcaster, Ghana Broadcasting Company (GBC), over an alleged failure to settle payments for a comprehensive range of web and IT services provided to a tune of $147,837.37.
The services rendered, according to the writ by the plaintiff, include web hosting, web design, licensing, TV streaming, domain name registration, web advertising, search engine optimisation, site maintenance, programming, email services, training, and IT support services.
These services were reportedly rendered under the service name www.gbcghana.com, as per the writ filed by ADS Media Agency, of which a substantial portion of the services were procured in United States dollars, which GBC is aware of.
Therefore, the plaintiff, wants GBC to pay the said amount of $147,837.37, or its equivalent in Ghana Cedis, to the IT firm.
This sum, according to the writ, represents accrued costs for dedicated server web hosting fees and premium support for both the www.gbcghana.com website and the TV License project, spanning from 2018 to 2023.
“The plaintiff states that most of its services for the defendant, including dedicated server web hosting services, live streaming anti-malware protection services, were procured by the plaintiff in United States dollars but invoiced to the defendant in the Ghanaian cedis equivalent of which the defendant is aware.”
“Plaintiff will say that GBC owes MyGhanaonline $147,837.37 or its cedi equivalent, being costs incurred for dedicated server web hosting fees and premium support for both www.gbcghana.com and the TV License project from 2018 to 2023,” part of the writs stated.
However, the Ghana Broadcasting Corporation, in response, denied the allegations put forth by the ADS Media Agency.
GBC contends that no agreement was signed that would obligate them to transform into a media powerhouse, as implied by the plaintiff.
More so, GBC labeled the statements made in paragraph 14 of the writ as libelous and defamatory, asserting that they were made with a malicious intent to tarnish and damage the hard-won reputation of the individuals mentioned.
“Defendant further says that the statements made in paragraph 14 are libelous and defamatory and were made with malicious intent to injure and damage the hard-won reputation of the said persons mentioned.”
