The hearing of the appeal against the court’s decision to dismiss an injunction filed against the extension of Kwame Nkrumah University of Science and Technology (KNUST) by an alumnus of the school, Kofi Clement Ohene Asare, has been scheduled for August 13.
The court dismissed the case on the basis that the injunction lacked merit. The judge who presided over the case questioned the status of the applicant, who had told the court that he was an alumnus.
The court also stated that the applicant failed to convince the court that he was an alumnus of the University when he tendered purported university statutes. The court later awarded a cost of GH¢9000 against the applicant.
Shortly after the court dismissed the application, the applicant expressed dissatisfaction with the court’s ruling and filed another suit to overturn the verdict of the court.
Asare is seeking an “order staying the execution of the court’s ruling delivered on the 30th day of July 2024 pending the determination of the appeal filed.”
He said the ruling of the court disregarded the binding prescription of statute, thereby enabling the defendants to benefit from their own wrong.
“The refusal of the honourable trial court to grant the injunction sought is contrary to settled fundamental principles of law,” he added.
