A member of the New Patriotic Party’s (NPP) legal team, Kingsley Amoakwa-Boadu has expressed support for Attorney General, Godfred Yeboah Dame’s intention to appeal the Court of Appeal’s ruling in the Ambulance case.
The Court of Appeal acquitted and discharged the Minority leader, Dr Cassiel Ato Forson and businessman Richard Jakpa on July 30, setting aside the order for Dr Forson to open his defence.
Speaking on The Big Issue on Channel One TV, Amoakwa-Boadu suggested that the AG appeal the case, focusing on the shipment process of the vehicles, which he believed was not properly done, resulting in financial loss to the state.
He cited a quote from Justice Bright Mensah, which attributed the financial loss to the recklessness, neglect, and apathy of Ministry of Health officials.
Amoakwa-Boadu argued that the prosecution should have connected Dr Forson and Richard Jakpa to the financial loss regarding the shipment, and that the AG should appeal the case based on the issuance of a Letter of Credit (LC) for the shipment.
He believes that the AG has grounds to challenge the ruling and is expected to do so.
“‘He’s saying that in any event if there was any financial loss or economic loss to the nation, the blame is attributed [to] the reckless neglect and apathy on the part of the officials of the Ministry of Health. So, it means that there has been financial loss.”
“The fact that there was even post inspection rather than pre-shipment inspection is a big issue. So, we expect that the prosecution should lay that is it’s bringing a charge against A1 and A2. It must connect them to that. The Lordship thinks that they haven’t connected enough but I am saying that by virtue of the fact that the shipment was done on the basis of an LC issue, the AG should appeal,” he stated.
