Private Legal Practitioner Jonathan Amable has voiced strong concerns over the Attorney General’s failure to file a response in a pending case that seeks to halt the government’s borrowing in the Treasury Bills market.
The case, which has been before the Supreme Court since February and November 2024, involves a plaintiff who is asking the court to stop the government and its agents from issuing Treasury Bills to finance government operations, citing the lack of parliamentary approval for such borrowings.
Amable argues that the government’s actions violate provisions of the 1992 Constitution and warns that if left unchecked, they could have serious negative implications for the economy.
He is also seeking an injunction from the Supreme Court, declaring the actions of the Ministry of Finance and the Bank of Ghana unconstitutional.
In an interview with Bernard Avle on Channel One TV’s The Point of View, Amable criticized the Attorney General, who is the defendant in the case, for not responding to the suit.
He pointed to instances where the government had acted quickly in similar cases, such as the anti-gay bill injunction and parliamentary seat vacancies.
Amable condemned the delay and called on the Attorney General to urgently file a response so the matter can be addressed promptly.
“Filed in February, up to date, the Attorney General has not filed a response. If the AG is dealing with the same principle, since I filed the suit on November 11, there won’t have been further T-bills issuances, but guess what, that Friday there was an issuance even though they have been served. They have issued a statement which indicates their further intention this Friday.
“They are acting as if no injunction application has been filed, and if the tables were turned, they would be screaming from the rooftop.”
He warned of citing the Attorney General Godfred Dame for contempt on November 26.
“I’m expecting the AG to file, but the way the AG is acting, it looks like there’s no intention file. And so, we are considering how we can escalate and cite the minister for contempt and by Tuesday we may have done that.”
