Court clears driver off blame in fatal crash involving motor rider

The Kaneshie District Court One has acquitted and discharged a commercial driver, whose vehicle was involved in a crash that resulted in the death of a motor rider.

Richard Agbenyamu, 62, was initially charged with careless and inconsiderate driving, as well as negligently causing harm to Abdul Rahman, 52, who later died from injuries at the hospital.

However, the court determined that the charges were unsupported by the facts and declined to accept a plea from Agbenyamu.

According to Police Chief Inspector Apewa Achana, on January 22, 2025, at about 0930 hours, Rahman was riding a Suzuki motorbike with registration number M-22-ge 976 from Abossey Okai Junction towards Agbogbloshie.

Upon reaching the Old Fadama Old Onion Market, he collided with the rear of Agbenyamu’s Hyundai Universe Bus with registration number GT 5272-19.

The prosecution said that Rahman suffered serious injuries and was quickly taken to the Accident Emergency ward of the Korle Bu Teaching Hospital for treatment but died later that same day.

Chief Inspector Achana said that Rahman’s body was deposited in the hospital’s morgue for preservation while awaiting autopsy.

After completing the investigation, Agbenyamu was charged with the alleged offences and brought before the court.

In delivering its ruling, the court dismissed the second charge of negligently causing harm, stating it was not applicable because Agbenyamu did not cause harm to the deceased.

The court concluded that it was the deceased who was negligent, as he collided with Agbenyamu’s vehicle.
