The Attorney-General and Minister of Justice, Dr. Dominic Ayine, has revealed his intention to meet with the Special Prosecutor, Kissi Agyebeng, to receive an update on the cases currently being investigated by the Office of the Special Prosecutor (OSP).
Dr. Ayine, while acknowledging that the OSP is expected to function as an independent body, emphasised the need for his office to stay informed about the various cases being handled by the Special Prosecutor.
He made these remarks during a press conference held in Accra, where he addressed several legal and governance issues.
Speaking on the subject, the Attorney-General explained that although the OSP operates independently, it remains an agency within the broader framework of the Attorney-General’s department.
According to him, under Article 88(3) of the 1992 Constitution of Ghana, the prosecutorial authority of the state is vested in the Attorney-General.
Therefore, he believes it is appropriate for his office to have oversight of the work being carried out by the Special Prosecutor.
“I think that it is only right that because he [Kissi Agyebeng] is exercising prosecutorial authority which belongs to me, under Article 88(3) of the Constitution, I should be in the known regarding his actions. So the OSP is one of the agencies under the Attorney General’s department.
“And at the appropriate time, I will call for a briefing on everything that he has done, including the press conference that he held. I myself woke up to the press conference.
