Don’t take the court’s powers lightly – Inusah Fuseini warns Ernest Kumi

Inusah Fuseini, the former Member of Parliament for Tamale Central, has issued a strong caution to politicians across Ghana, urging them to respect the authority of the courts and avoid actions that undermine judicial power.

His warning comes in the wake of the recent contempt of court conviction of the Member of Parliament for Akwatia, Ernest Yaw Kumi, who defied a court order and was subsequently found guilty of contempt.

Speaking on The Big Issue on Channel One TV with host Selorm Adonoo, Fuseini stated that the laws of the land are firm and are enforced whenever and wherever the powers and orders of the court are disregarded.

Inusah Fuseini made it clear that no politician is above the law and that courts have the authority to take decisive action against those who choose to defy their orders.

He advised politicians to be cautious and avoid disregarding the judiciary, as legal consequences are inevitable for those who do.

“I will not advise any politician to take the powers of the court lightly. You might disagree with them but they can deal with you and they deal with you based on the facts that are before them and their understanding and application of the law and how they relate to you.

“And so if the court somehow comes to the conclusion that the facts that were before them in Koforidua are facts that warrant that a stay be granted, it would have limited the injunction to a number of days.”

He further explained that judicial decisions are rooted in the examination of facts and legal provisions, stating that court rulings are not arbitrary but are based on a detailed analysis of the case at hand.

The case against Ernest Yaw Kumi originated from a ruling by the High Court in Koforidua, which placed an interim injunction on his swearing-in as a legislator due to legal challenges surrounding his election.

Despite the court’s directive, Kumi proceeded with his swearing-in, prompting legal action against him.

The High Court found his actions to be in contempt and convicted him accordingly.

A bench warrant was subsequently issued for his arrest after he failed to appear before the court for sentencing, further escalating the situation.
