Ashanti Region: Court throws out NDC’s petition on three parliamentary election results

A High Court in Kumasi has thrown out a petition brought by the National Democratic Congress (NDC) aimed at overturning the 2024 parliamentary election results in three constituencies.

The NDC had earlier sought to dispute the declared results, which saw the NPP emerge as victors in Ahafo Ano South West, Obuasi East, and Ahafo Ano North, insisting that its candidates were the rightful winners despite the official recounts and the swearing-in of New Patriotic Party (NPP) Members of Parliament.

The NDC’s legal team had sought to reverse the results on the grounds of irregularities.

However, the legal team for the NPP MPs argued that the NDC petitions were procedurally flawed, noting that the petitioners failed to request a determination of security for costs within the 21-day window after the election results were gazetted: a mandatory requirement under electoral law.

The court ruled that the petitions lacked procedural merit and dismissed them. Additionally, the court imposed financial penalties on the NDC, ordering them to pay GHC10,000 Ghana cedis in the Ahafo Ano North case and 30,000 Ghana cedis each in the Ahafo Ano South West and Obuasi East cases.

Shadrach Obeng Yeboah, the legal counsel for the NPP MPs, expressed satisfaction with the court’s decision.

“It’s a victory for my clients. It’s also a victory for the administration of justice. We’re happy that our applications have been granted, it’s a victory for our party,” he said.
