The High court has halted the hearing of the criminal case involving the Member of Parliament for Bawku Central, Mahama Ayariga, for allegedly flouting procurement procedures in the purchase of an ambulance for the Bawku Municipal Assembly.
The court presided over by Justice Efia Serwaa Botwe stayed proceedings pending the Supreme Court’s decision of the legitimacy of Martin Amidu to hold the Office of the Special Prosecutor.
Lawyers for Mr. Ayariga filed an application for stay of proceedings pending the determination of the case at the Supreme Court after his earlier case was dismissed by the High Court.
Mr. Ayariga and six other officials of the Bawku Municipal Assembly had been arraigned by the Special Prosecutor for allegedly breaching the procurement laws in the purchase of an ambulance.
His lawyer, Godwin Tamakloe, had filed an application to strike out the on the grounds that Mr. Amidu was not qualified to occupy the office due to his age.
The High Court earlier dismissed the case on the grounds that Mr. Amidu was duly sworn in by the President as the Special Prosecutor and he would continue to remain at post until the Supreme Court decides otherwise.
