The Supreme Court in a 5-2 decision on Wednesday, April 13, 2022, restrained James Gyakye Quayson from holding himself as the Member of Parliament for the Assin North constituency in the Central Region until the final determination of an election petition filed against him.
This decision was taken in a petition brought before the Supreme Court by Michael Ankomah-Nimfa, a resident of Assin Bereku in the Central Region who had insisted that Mr. Quayson was not qualified to contest the Assin North parliamentary seat because, at the time of filing his nomination, he owed allegiance to another country other than Ghana.
Mr. Ankomah-Ninfa is seeking the Supreme Court’s interpretation of Article 94(2)(a) of the 1992 Constituency. He also filed an application of an interlocutory injunction to prevent Mr. Quayson from holding himself as MP for Assin North.
The apex court, per the majority decision, said restraining Mr. Quayson for a few weeks for the substantive case to be determined in the next few weeks “will not occasion any irreparable loss or damage to applicant or anyone.”
